Terms of Service
These are the terms you buy under. They are written to be read rather than to be impressive.
Who you are dealing with
encoregalerie.com sells restored reproductions of public-domain paintings. Contact is hello@encoregalerie.com.
Placing an order
Adding something to your basket is not an order. Your order is placed when you pay through Stripe, and accepted when we confirm it by email. Until then either of us can walk away.
We may decline an order: an address we cannot deliver to, a price that was published in error, or an order that looks fraudulent. If we decline one you have paid for, you get all of your money back.
Prices
All prices are in US dollars and include delivery to the 6 countries we serve. There is no separate shipping charge and no minimum order.
Prices can change, but never after you have paid. The price you see at checkout is the price you are charged.
What you are buying
A giclee reproduction of a painting that is out of copyright, printed and framed to order. Not an original work, not hand-painted, and not produced by the artist named in the title. Each product page states which copyright tests the composition passed.
Each piece is restored rather than merely scanned: the yellowed varnish and the craquelure of a two-hundred-year-old object are taken off so the painting reads as it did when it was finished. The composition, the drawing and the colour are reproduced and not reinterpreted. Every product page carries a slider showing our version beside a scan of the original, so you can see exactly what changed before you buy.
Every screen renders colour differently and no screen is made of paper. We reproduce each painting as faithfully as the process allows, but a print will not match your monitor exactly, and that difference is not a fault.
Delivery
3 to 13 business days, free, to the countries listed on shipping. Those dates are estimates rather than guarantees: once a parcel is with a courier its progress is not something we control.
Risk passes to you on delivery. If it arrives damaged, that is ours to fix.
If something goes wrong
Damaged, faulty or not what you ordered: we remake it or refund it, and nothing has to be posted back. Change of mind is not covered, because each piece is made for one order. The full position is on returns and refunds.
Copyright in our own work
The underlying compositions are public domain and belong to everyone. Our restorations, page copy and the arrangement of the catalog are ours. Buying a print gives you the print. It does not give you the right to copy, scan, reproduce or resell our version of the image commercially.
If a work should not be here
Every piece we sell is public domain in both the EU and the US, and every product page shows the year and the reasoning. If you believe a specific work does not clear one of those tests, write to hello@encoregalerie.com with the piece and the basis, and we will take it down while we check rather than after.
What we are responsible for
If we get your order wrong, we fix it or refund it. What we are not liable for is indirect loss: a piece that misses an occasion, or costs incurred because a delivery ran late. Our liability is limited to what you paid for the order.
Nothing here removes rights you have by law where you live, including UK, EU and Australian consumer law.
Changes
These terms may change. The version that applies to your order is the one published when you placed it.
Governing law
New Zealand law governs these terms. That does not deprive you of the protection of consumer law in your own country.
